INXPO MOBILE APPLICATION TERMS of USE
Due to the space
constraints associated with mobile applications, INXPO has provided the
following as a summary of the Terms of Use, please review the Terms of Use in
their entirety, located at www.INXPO.com/terms/INXPO_Terms_of_Use.pdf.
INXPO provides the INXPO
Mobile Application in order to allow you to access virtual events provided on
the INXPO virtual event software platform from your mobile device (“Mobile
App”) in order to access and use the virtual event sponsored by the named
virtual event sponsor.
This INXPO Mobile
Application Terms of Use includes the INXPO Terms of Use INXPO Privacy Policy
and the Community Guidelines (collectively the “Terms of Use”). The Terms of
Use apply to your access of the virtual event delivered to you via the Mobile
App, please review them carefully. By entering this virtual event you signify
your agreement to the Terms of Use; if you do not agree to the Terms of Use, do
not access the virtual event. Any reference to your access to or use of a
virtual event also means your access to or use of the Mobile App.
You must register, using
accurate user account information and be over the age of 13 in order to access
the virtual event.
Prohibited Activity. In connection with your use of the virtual event, you
are prohibited from harassing other users, using offensive, derogatory, or
defamatory language, introducing harmful elements, circumventing security
features, providing false registration information, accessing via another user’s
account or through any means other than through the website itself, harvesting personal
information, soliciting other users for commercial purposes, distributing spam email,
violating any third party’s intellectual property rights, including INXPO or
the sponsor.
Intellectual Property. Except for your or other user’s submissions, all
content, documents, presentations, videos, logos, trademarks and other
materials provided or made available through the virtual event are the property
of INXPO and/or the virtual event sponsor. You may not copy, reproduce,
publish, distribute, transmit, publicly perform or create derivatives of the
materials provided to you through the virtual event. You grant INXPO and the
sponsor the rights specified in the Terms of Use with respect to your
submissions.
Warranties and Liability.
INXPO provides the virtual event to you “As Is” and expressly disclaims all
warranties, including fitness for a particular purpose, implied warranty of
merchantability and warranty of title. To the maximum extent permitted by law,
neither INXPO nor the virtual event sponsor will be liable to you, for any
claim for any damages, including direct, indirect, special, incidental or
consequential damages, arising out of your access and use of the virtual event.
Indemnity. You are solely
liable for your actions or omissions within the virtual event. You agree to
indemnify INXPO and the virtual event sponsor for any action arising out of
your use of the virtual event.
Website Location. The virtual event website is deemed passive and
located in Chicago, Illinois and shall not subject INXPO to jurisdiction in any
venue other than Illinois. All claims or disputes shall be resolved in Cook
County, Illinois under the substantive laws of the State of Illinois, without
regard to conflict of law principles.

Terms Specific to the Apple App Store:
The Mobile App is made
available you through the Apple App Store, the Terms of Use, however, are an agreement between You and INXPO and will not be
construed to be an agreement between You and Apple. Apple is not responsible
for (i) the maintenance or support of the mobile
application, (ii) the content made available through the Mobile App, (iii) the
investigation, defense, settlement or discharge of any intellectual property
infringement claim arising out of your access and use of the Mobile App, (iv) product liability claims, (v) any claim
that the Mobile App fails to conform to any applicable legal or regulatory
requirement, or (vi) claims arising under consumer protection or similar
legislation.
You are granted the
non-transferrable right to access the Mobile App from your iPhone or iTouch that you own or control. Your access to the Mobile
App through the Apple App Store is also subject to the applicable Usage Rules,
as set forth in the Apple App Store Terms of Service.
Apple makes no
representation or warranty to the Mobile App and has no obligation whatsoever
with respect thereto, or to any other claims, losses, liabilities, damages,
costs or expenses attributable thereto.
You represent and warrant
that (i) you are not located in a country that is
subject to a U.S. Government embargo, or that has been designated by the U.S.
Government as a “terrorist supporting” country, and (ii) you are not listed on
any U.S. Government list of prohibited or restricted parties.
You agree that Apple, and
Apple’s subsidiaries, are third party beneficiaries of the Terms of Use, and Apple
will have the right (and is deemed to have accepted the right) to enforce the
Terms of Use against you as a third party beneficiary thereof.

This Mobile Application Privacy
Statement summarizes how INXPO, Inc. treats personal information when you, the
user, attends a virtual event, hosted on the INXPO
Platform, for the benefit of the virtual event sponsor. These terms are between
you, the user and INXPO and the sponsor of the virtual event.
The Privacy Policy and this
summary may be updated any time, with or without notice to you.

collected by INXPO

INXPO
adheres to Safe Harbor Principles and applies those principles to any transfer
of information between the European Union countries and INXPO

User activity while attending the virtual event
(includes the website you came from and the website you go to when you leave
the event and any activities you conduct within the event)

We may use GIFs (a.k.a. web
beacons) in HTML-based emails sent to you to track which emails are opened.

Content that you upload or make
available within the virtual event

INXPO automatically receives the URL of the site
from which you came and the site to which you are going when you leave INXPO.
We also receive the Internet protocol (IP) address of your computer (or the
proxy server you use to access the World Wide Web), your computer operating
system and type of web browser you are using, as well as the name of your ISP

INXPO does not collect or store transaction data
such as credit card information, health information, social security numbers,
banking information or similar highly sensitive data

INXPO
uses web beacons, cookies, LSO’s clear gifs, and log file information to: (i) store information so that you will not have to re-enter
it during your visit or the next time you visit the event; (ii) provide custom,
personalized content and information; (iii) monitor aggregate metrics such as
total number of visitors, pages viewed, etc.; and (iv) track your entries,
submissions, and status in promotions, sweepstakes, and contests.

Access to Your Information. To change your personal information,
you may make any changes to your profile information by updating that section
or by contacting support@inxpo.com.
Transfer
of Your Information to Third Parties. INXPO does not transfer your
information to third parties; however, the event sponsor will have access to
your information. In addition, third party advertisers will have access to your
information if you click such advertiser’s link or if you log into your account
with a third
party social networking site from the event.
Security.
INXPO takes all
reasonable steps to prevent the loss, misuse and
unauthorized access, disclosure, alteration and destruction of your
personal information.
Enforcement and Dispute Resolution. All disputes shall be handled in
accordance with the Privacy Policy. Complaints or privacy related notices may
be sent to privacy@INXPO.com.
